If a "contract" to purchase property from a "seller" is "cancelled" by the "seller" - should the attorney representing the "buyers" be allowed to do the following:
Request the "sellers" attorney to make the check payable to himself instead of the "buyers";
Charge the "buyers" a "cancellation fee" for the "Title Search and Survey Search" which was requested by the attorney;
Automatically deduct these "cancellation fee" charges from the "buyers" downpayment monies.
Please advise if this is an allowable, legitimate action on the part of the attorney who was to represent the "buyers" in the Real estate transaction.
